State and Local Rates Can Be Higher
States such as California, New York, Washington, and many cities set minimum wages above the federal floor. Where multiple rates apply, covered workers are generally entitled to the higher rate.
Tipped Employees
The federal tipped cash wage is $2.13/hour, but tips plus cash wages must reach at least the $7.25/hour federal minimum wage. State tipped wage rules may be more protective.
Overtime
Nonexempt employees generally receive overtime at 1.5 times the regular rate for hours over 40 in a workweek.
